Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SageonRQ websites, applications, software, Retirement Opportunity Audits, Retirement Strategy Navigator reports, subscription services, analyses, reports, tools, content, and related products and services (collectively, the “Services”).

By accessing the Services, creating an account, purchasing a product or service, or otherwise using SageonRQ, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

1. Purpose of SageonRQ

SageonRQ provides technology-assisted retirement analysis designed to help users identify, evaluate, and better understand potential retirement-planning opportunities.

SageonRQ may evaluate information relating to retirement income, taxes, Social Security, pensions, required minimum distributions (“RMDs”), Roth conversions, retirement assets, investment assumptions, inflation, survivor scenarios, legacy considerations, and other retirement-planning factors.

SageonRQ uses software, mathematical models, algorithms, and artificial intelligence-assisted technologies to perform analyses and generate reports.

2. Educational and Informational Purpose

SageonRQ Services, analyses, reports, projections, and other content are provided for educational and informational purposes.

Unless expressly provided through a separately established professional advisory relationship, use of SageonRQ does not create an investment advisory, financial planning, tax, accounting, legal, fiduciary, or other professional relationship.

SageonRQ reports should not be the sole basis for implementing a material financial, investment, tax, Social Security, estate-planning, insurance, or legal decision.

Users should consider consulting appropriately qualified professionals before implementing strategies identified through SageonRQ.

3. Information You Provide

You are responsible for providing accurate, complete, and reasonably current information.

SageonRQ results depend upon the information entered into the system and the assumptions applied to that information. Incorrect, incomplete, estimated, or outdated information may materially affect an analysis.

SageonRQ may provide different levels of analysis using different amounts of client information. A preliminary analysis or Retirement Opportunity Audit based upon general information may produce different results from a more detailed analysis using account statements, tax returns, Social Security records, pension information, cost basis, or other documentation.

4. Projections and Modeling Assumptions

SageonRQ projections are hypothetical estimates based upon information provided and modeling assumptions.

Assumptions may include, among other things:

  • Investment returns;
  • Inflation;
  • Social Security cost-of-living adjustments;
  • Federal and state tax laws;
  • Filing status;
  • State of residence;
  • Retirement spending;
  • Retirement age;
  • Planning horizon;
  • Required minimum distributions;
  • Roth conversions;
  • Account growth;
  • Survivor scenarios; and
  • Other future financial conditions.

Actual results will differ from modeled results.

SageonRQ does not guarantee future investment performance, tax savings, income, account values, retirement outcomes, or any other projected result.

5. Investment Information

Investment returns used in SageonRQ analyses are hypothetical modeling assumptions and are not guaranteed returns.

Nothing provided through SageonRQ constitutes a recommendation to purchase, sell, or hold a particular security, investment product, or investment strategy unless expressly provided through a separate professional relationship authorized to provide such advice.

Investments involve risk. Actual investment results may be materially higher or lower than projected results and may include loss of principal.

6. Tax Information

SageonRQ may estimate federal and state income taxes and evaluate the potential tax effects of retirement strategies.

Tax calculations are estimates based upon information provided, applicable modeling assumptions, and the tax-law year used in the analysis.

Tax laws, tax rates, deductions, exemptions, Social Security taxation, state tax treatment, and other tax provisions may change.

SageonRQ does not provide individualized tax or accounting advice through its automated Services and is not a substitute for advice from a qualified tax professional.

7. Social Security

SageonRQ may model Social Security benefits based upon information provided by the user and assumptions regarding benefit commencement, cost-of-living adjustments, taxation, survivor benefits, and other factors.

Actual Social Security benefits and applicable laws may differ from modeled amounts.

Users should verify material Social Security decisions with the Social Security Administration or an appropriately qualified professional.

8. Required Minimum Distributions

SageonRQ may project RMDs based upon applicable rules and projected pretax retirement-account balances.

For modeling purposes, required distributions are not necessarily assumed to be consumed. Amounts not required for modeled spending or taxes may remain part of projected household assets.

A reduction in projected RMDs or other forced taxable distributions does not guarantee a corresponding reduction in actual taxes or an improvement in actual retirement outcomes.

9. Roth Conversion Analysis

SageonRQ may evaluate multiple Roth-conversion amounts, timing alternatives, and strategies.

Modeled Roth-conversion results are hypothetical and may depend upon factors including:

  • Current and future tax rates;
  • Taxable income;
  • Social Security taxation;
  • Deductions and phaseouts;
  • State taxation;
  • Investment performance;
  • Cash available to pay conversion taxes;
  • Medicare-related costs;
  • Required minimum distributions;
  • Estate and legacy considerations; and
  • Future changes in law.

A modeled Roth conversion opportunity is not a recommendation to complete a Roth conversion without further review.

Users should consider consulting qualified tax and financial professionals before implementing a Roth conversion.

10. Survivor and Longevity Modeling

When applicable, SageonRQ may model the financial impact of the death of a spouse or other longevity-related events.

Such modeling is a planning stress test and not a prediction of lifespan, mortality, or the timing of death.

Survivor results depend upon assumptions and information available to SageonRQ and may differ materially from actual outcomes.

11. Payments

Prices for SageonRQ products and Services are disclosed at the time of purchase.

By completing a purchase, you authorize SageonRQ and its payment-processing providers to charge the payment method you provide for the amount disclosed at checkout, including applicable taxes or other charges where required.

You are responsible for providing accurate billing and payment information.

12. No-Refund Policy

ALL SAGEONRQ PURCHASES ARE FINAL AND NON-REFUNDABLE, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW.

SageonRQ analyses and reports are generated using information provided by the user, and digital processing may begin immediately following purchase. Accordingly, SageonRQ does not provide refunds, credits, or exchanges after a purchase has been completed except where required by law.

A refund will not be provided because:

  • Information was entered incorrectly;
  • Information was omitted;
  • Information was estimated;
  • Information later changed;
  • The user disagrees with or is dissatisfied with the results;
  • The analysis identifies fewer opportunities than expected;
  • No Roth conversion opportunity is identified;
  • No projected tax savings are identified;
  • No improvement over the Current Plan is identified; or
  • The user decides not to use or implement the information provided.

Purchase of a SageonRQ product or Service does not guarantee that SageonRQ will identify a financial improvement, tax savings, increased retirement value, Roth conversion opportunity, reduction in RMDs, or any other favorable planning result.

The absence of a favorable modeled outcome does not entitle the user to a refund.

13. Technical Problems

If a technical error attributable to SageonRQ prevents delivery of a purchased product or Service, contact:

Where appropriate, SageonRQ may correct the technical issue, regenerate the analysis or report, restore access to the purchased Service, or provide another appropriate remedy.

A technical issue does not automatically create a right to a monetary refund except where required by applicable law.

14. Subscription Services

Certain SageonRQ Services may be offered on a recurring subscription basis.

When purchasing a subscription, the price, billing frequency, and applicable subscription terms will be disclosed before purchase.

By purchasing a recurring subscription, you authorize SageonRQ and its payment provider to charge the applicable subscription fee to your payment method at each renewal until the subscription is canceled.

Unless otherwise stated at purchase, subscriptions automatically renew according to the billing frequency disclosed at checkout.

15. Subscription Cancellation

You may cancel a subscription in accordance with the cancellation methods made available by SageonRQ.

Cancellation prevents applicable future renewal charges but does not ordinarily result in a refund or credit for amounts already paid, except where required by law.

Unless otherwise stated, cancellation remains effective at the end of the then-current paid subscription period, and access may continue through that period.

Deleting an account or discontinuing use of SageonRQ does not necessarily cancel a recurring subscription. Users are responsible for completing the applicable cancellation process.

16. Prices and Changes to Services

SageonRQ may change prices, features, product offerings, subscription terms, or Services from time to time.

Changes to recurring subscription prices will be handled in accordance with applicable law and any notice requirements.

SageonRQ may also modify, add, suspend, or discontinue features or Services.

17. Accounts and Security

If an account is required, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to notify SageonRQ promptly if you become aware of unauthorized access or use.

SageonRQ may restrict, suspend, or terminate access when reasonably necessary to protect users, SageonRQ, its systems, or other parties.

18. Acceptable Use

You may not:

  • Use SageonRQ for unlawful or fraudulent purposes;
  • Attempt unauthorized access to SageonRQ systems or data;
  • Interfere with security or operation of the Services;
  • Introduce malicious code or harmful technology;
  • Use automated means to improperly extract proprietary data;
  • Reverse engineer SageonRQ technology except where expressly permitted by law;
  • Reproduce or commercially exploit proprietary SageonRQ methodologies without authorization; or
  • Use SageonRQ in a manner that infringes the rights of others.

19. Intellectual Property

SageonRQ software, methodologies, algorithms, reports, designs, graphics, text, trademarks, branding, and other proprietary materials are owned by or licensed to SageonRQ and protected by applicable intellectual-property laws.

Users may retain and use reports generated specifically for them for personal purposes and may share those reports with their professional advisors.

No other right to reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit SageonRQ intellectual property is granted unless expressly authorized.

20. Third-Party Services

SageonRQ may rely upon third-party providers for payment processing, hosting, communications, analytics, data, security, artificial intelligence, or other technology and services.

SageonRQ is not responsible for third-party services beyond the extent required by applicable law.

Third-party services may also be governed by their own terms and privacy policies.

21. No Guarantee of Results

SageonRQ does not guarantee that any strategy identified through the Services will:

  • Reduce taxes;
  • Increase retirement income;
  • Reduce RMDs;
  • Increase retirement assets;
  • Improve investment performance;
  • Increase Roth or tax-free assets;
  • Improve survivor outcomes;
  • Reduce financial risk; or
  • Produce any other specific financial result.

Actual results depend upon future circumstances that cannot be known with certainty.

22. Limitation of Liability

To the fullest extent permitted by applicable law, SageonRQ and its affiliates, owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to use of or reliance upon the Services.

SageonRQ will not be responsible for financial decisions implemented solely in reliance upon hypothetical projections, estimates, assumptions, or automated analyses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

23. Privacy

Use of SageonRQ is also subject to the SageonRQ Privacy Policy .

The Privacy Policy describes how SageonRQ collects, uses, stores, and otherwise handles personal information.

24. Electronic Communications

By using SageonRQ, you consent to receive communications relating to your account, purchases, analyses, reports, subscriptions, security, and Services electronically where permitted by law.

Marketing communications will be handled in accordance with applicable law and available communication preferences.

25. Changes to These Terms

SageonRQ may update these Terms periodically.

The current Terms and effective date will be made available through the SageonRQ website or Services.

Continued use of the Services following an effective update constitutes acceptance where permitted by applicable law. Where additional consent or notice is legally required, SageonRQ will provide it.

26. Governing Law and Disputes

These Terms will be governed by the laws of Missouri, without regard to applicable conflict-of-law principles.

Any additional dispute-resolution, venue, arbitration, class-action waiver, or similar provisions adopted by SageonRQ will be stated in the applicable Terms and should be reviewed by legal counsel before implementation.
